Right to Counsel

Right to Counsel

The Sixth Amendment affords the right of the accused to have an attorney assist in their defense. But when does the accused gain the right? The Supreme Court has ruled that criminal defendants gain the right to counsel at or after the time that judicial proceedings begin. This includes a formal charge, preliminary hearing and arraignment.
